Thank you for your interest in using the electronic services of Muang Thai Insurance Public Company Limited (MTI). By clicking the “Register” button before accessing to use MTI electronic services means that you have thoroughly read, understood and agreed to the MTI's main terms of electronic services (“Main Terms of Service”), specific terms and conditions as well as the terms and conditions of business partners which are specified in the main terms of services. These terms and conditions govern the use of MTI electronic services in Thailand. Please read the main terms of service, specific terms and conditions and the terms and conditions of business partners with care, as these terms and conditions affect your own rights and obligations. If you do not accept the main terms of service, specific terms and conditions and the terms and conditions of business partners, please terminate the use of MTI electronic services in all systems.

1. Definition

Unless specifically defined in the specific terms and conditions of each electronic service system, the following terms shall mean as follows:

“Company” means Muang Thai Insurance Public Company Limited, who develops, owns and provides MTI electronic services on all platforms.

“MTI Electronic Services” mean all electronic service systems of Muang Thai Insurance Public Company Limited on all platforms, such as Mobile Application, Line OA or Website developed, owned and provided by the Company, which users can use to submit requests to use the Company’s services.

“Business Partner” means the relevant third party who agrees to provide services requested by users via MTI electronic services.

“User Account” means an online account created by the Company for each user on the MTI electronic services upon registration, whereby the user may submit a request to use the Company’s services to be processed through such account.

“User or you” means a user of MTI electronic services who submit a request to use the Company’s services, whether as a customer or not as a customer of the Company, which has been approved by the Company to access MTI electronic services.

“Username” means the name of a user created for the use of MTI electronic services.

“Password” means a code created by a user for the purpose of verifying identity, proving ownership of the user account, and accessing MTI electronic service system, which is

established in accordance with these electronic terms and conditions by being used together with created username.

“Social Media Account” means an account used by a user of digital platforms for the purpose of communicating, exchanging in social media such as Facebook, Google, Line and Apple ID.

2. Agreement

2.1 The user may apply for and use MTI electronic services only if the user is able to make juridical act with the Company, and the use of such services is subject to these terms and conditions, as well as all applicable national and international laws, rules and regulations. If the user is under the age of 20 or under the age of majority, the user shall certify that he/she is given a consent by his/her parents or legal representatives to use MTI electronic services for the purposes specified in these terms and conditions, and the user agrees to deliver the evidence or document of such consent to the Company as soon as requested. If the user fails to provide the evidence or document within the specified period, the Company reserves the right to suspend the use of MTI electronic services, and/or cancel his/her user account without prior notice.

2.2 In using MTI electronic services, the Company may send messages/notifications to the user as part of the normal business operations via the electronic service system.

2.3. In using MTI electronic services, the user agrees that:

2.3.1 The user shall only use the services for lawful purposes.

2.3.2 The user will only use the services for the purpose for which it is intended to be used.

2.3.3 The user will not use MTI electronic services and/or the services for fraudulent purposes.

2.3.4. The user shall not use the MTI electronic services and/or the services for any purpose other than using the services.

2.3.5. The user shall not cause damage or obstruct the network operation of MTI electronic services and/or the network of services.

2.4. The user has read and accepted these terms and conditions of MTI electronic services.

2.5. By using the service, the user agrees to comply with all terms and conditions of electronic services that the information provided by the user for the Company for the purpose of using the service is true, complete and up-to-date. The Company does not have a duty and responsibility, whether directly or indirectly, in the event that the information provided by the user is false, not out-of-date, incomplete or inaccurate.

3. Username and Password

3.1 The user shall create the username and password by himself/herself in order to apply for the use of MTI electronic services. In the event that the user is the Company’s customer who has already registered to use MTI electronic services, you may use the same username and password to access the Company's other electronic services, as determined and permitted by the Company.

3.2 The Company shall determine the methods and conditions for using MTI electronic services and other related services, with the username and password in accordance with the methods and conditions determined or permitted by the Company.

3.3 The user can change the password by himself/herself throughout the period of using MTI electronic services without notifying the Company, and agrees that the changed password is fully binding the user. The changed password must comply with the conditions set by the Company. This password is confidential information that the user is obliged to keep and shall not disclose to any other person, including the Company.

3.4 In the event that the user wishes to revoke the username and password as such username and password are being hacked, the user must immediately revoke the old username and password by contacting the Company via telephone number 1484, 24 hours a day.

3.5 Any action taken on MTI electronic services by username and password of the user indicates that it is the user’s action, and that such action is complete, whether or not caused by a fraudulent purpose of the third party. The Company shall not be responsible for any mistake or damage that may arise from the username and password of the user, and the user shall not use it as an excuse or evidence to argue against or sue the Company.

The user shall keep password and account details confidential, and be responsible in all cases for any transactions or activities done by his/her account, regardless of whether such transactions or activities are acknowledged or authorized by you.

MTI electronic services may provide a password management system for the user that will allow the system to memorize your password and automatically enter the password for you in an appropriate manner. When you enable the password management system to memorize your password, you will be asked if you would like the system to memorize the username and password for that electronic service.

The Company shall not be responsible for any damage, loss or other liability caused by the user or any transaction whatsoever as a result of unauthorized use of the user's account or

password by the third party, and shall not be liable to the use of password management system by the user.

However, the user may be liable for damage, loss or other liability incurred by the Company for any misuse of your account and/or password. The user must report to the Company as soon as the user becomes aware or has a reasonable ground to suspect that the security of your password and/or account may have been compromised or used by other person without authority.

4. Scope of Services and Conditions

4.1 The user may use MTI electronic services and any related services in accordance with the processes and methods determined by the Company or via other channels as determined by the Company in the future.

4.2 The user understands and acknowledges that the use of MTI electronic services and any related services shall take a reasonable period of time for the Company to take the necessary steps in providing the services. The user agrees that he/she shall not call for the Company’s responsibility for any damages caused by a delay in the process of implementation.

4.3 In the event that the computer or communication systems of the Company, the users, the internet service providers or the mobile operators, including electrical system, telecommunication system, or any other systems related to the service are in failure, interrupted, in the process of repairing or temporarily shutting down for maintenance, with the result that the users are unable to use the services, the users agrees not to take such incidents as a reason to call for the Company’s responsibility.

4.4 Any documents related to the use of MTI electronic services sent by the Company to the user at home, work or school address or by electronic mail (email) provided by the user or subsequently changed by the user shall be deemed to be acknowledged by the user.

4.5 The user agrees that the Company may collect, use, inquire or disclose some or all details about the user, which is not personal data that the Company has known due to the user's use of services with the Company or with any person and/or juristic person, as necessary and appropriate for the purpose of improving the operation and provision of services. The Company does not require the prior permission or consent of the User. This consent shall be deemed to be in effect forever, even if the user may no longer use MTI services. In case of personal data, the Company shall perform in accordance with the Company's privacy notice on the collection of personal data.

4.6 In the event that the Company requires to communicate, send message or notify the user of information, the user agrees that the Company may do so via MTI electronic services, channels, or other forms of media as deemed appropriate, including when the Company requires to notify of changes in these terms and conditions.

4.7 These terms and conditions will not terminate or replace any other terms and conditions of the Company that may apply to you. You will continue to be bound by other terms and conditions to which you are still bound. These terms and conditions are binding the user additionally.

4.8 In the event that these terms and conditions contradict the Company’s other terms and conditions, if they are applicable to the use of MTI electronic services, they shall be governed by these terms and conditions. In the event of doubt as to their application, the Company's decision shall be final.

4.9 Access to some function or part of MTI electronic services may be subject to additional specific terms and conditions. The user shall agree to be bound by those additional terms and conditions. However, prior to using such specific service, the Company shall inform the user of such terms and conditions.

5. User’s Liability

5.1 The user agrees and consents to indemnify the Company, as well as its affiliates, business partners, licensors of intellectual property rights (if any), officers, employees, directors, representatives of the Company and any other related parties as determined by the Company (the “Indemnified Parties”) for any damages (including reasonable attorneys' fees) that may arise out of, or in connection with any right, legal procedures, claim or filing a lawsuit by the third party. which cause the Company to have liability in connection with MTI electronic services or these terms and conditions due to (i) the use or other actions of the user that violate the law or these terms and conditions, or (ii) the user's intentional or negligent action that causes damages or violates any rights of the third party.

5.2 When any information of the user is changed or affects the use of MTI electronic services, including the provision of online policy services, insurance premium payment and claim notification, the user must notify the Company immediately. In such case, the user agrees to accept that the error in transactions caused by such change, and the user must contact the Company immediately upon discovering of such error via available channels. The following information shall be provided:

 

• Transaction date and time

• Transaction type

• Detail of error

• Name and address where user can be contacted

The user agrees that the Company shall not be liable for any damages arising from the user's notification of changes in relation to the use of MTI electronic services.

6. Company’s Liability

The Company is the developer and provider of MTI electronic service, which is a technological platform for the user. The Company shall be liable to the user or any loss or damage resulting from the services, whether jointly or individually, only to the extent permitted by applicable laws. The user acknowledges and agrees that all risks incurred from the use of the services by the user are the risks that the user has no rights of recourse against the Company in any case, except when it is proved that the damage is caused by the Company's breach of the main terms of service, severe negligence or fraud. However, this clause applies only to users who strictly and fully comply with the terms and conditions of the Company.

7. Collection and Use of Data

7.1 You can use your information from your social media accounts to help register for accessing MTI electronic services and related systems. The Company will use your name to create an account name and use your location to help the website recognize your province where you live. Your registration of accessing or using MTI electronic services with that social media account means that you accept and allow the Company to link through the account and collect, use and disclose your information including your personal data. Upon your registration with that social media account, you must "allow" the Company to access your social media information only necessary. Such information includes the user's profile information (such as name, profile photo, gender, email, etc.) and other additional information provided by the user during the use of social media.

7.2 The Company can provide more useful information to user if you allow the Company to access your current location information (for example, through mobile phone with a GPS system). The Company will keep such information in accordance with the Company's privacy notice on the collection of personal data. If you want to conceal or disallow the Company to access this information, you can turn off the GPS on your mobile phone.

7.3 The Company will automatically collect information in connection with your use of MTI electronic services and online policy services, for example, making any correction to personal data, telephone numbers, and the date and time of your use of MTI electronic services, in order to improve the provision of services, keep your information up to date and accurate and for analysis of user’s behavior of using various functions of MTI electronic services and related systems.

7.4 In the event that the data to be collected, used and disclosed (“data processing”) by the Company is personal data according to applicable data protection laws (including the processing of the user's data specified in No.7), the processing of such personal data is in accordance with the Company’s privacy notice on the collection of personal data.

8. Notification

The user can set up notifications of MTI electronic services in the “Settings” button. By allowing to receive the Company’s notifications in the form and conditions you set up, you give your consent to the Company in sending you messages. If you wish to cancel or modify your notification setting, you can make a change via MTI electronic services.

9. Payment Methods and Conditions

9.1 The payments and receipts of money made through MTI electronic services will only be made by methods and channels determined and authorized by the Company. The user’s transaction of payment and receipt of money made by the methods other than those determined and authorized by the Company will be deemed an incomplete transaction. The user acknowledges that any payment, receipt and refund of money made through the banks or the third party, an error, a delay or malfunction during the transaction of payment, receipt or refund of money are not under the Company's control and liability.

You agree that the Company shall not be liable for any damages arising out of any error, delay or malfunction caused during the transaction of payment and receipt of money.

9.2 The user allows the Company to make a change, modify or terminate the service with respect to payment and receipt of money through MTI electronic services at any time. In the event that the Company terminate the service with respect to payment and receipt of money through MTI electronic services, the Company will notify you of such change in a timely manner.

10. Access to Networks and Devices

10.1 The user is responsible for providing information in accessing the network to use MTI

electronic services. By accessing and using MTI electronic services via his/her mobile phone, the user shall be responsible for any costs in connection with the user's telecommunication service provider.

10.2 The Company does not guarantee that MTI electronic services are always functional properly on any types of device.

10.3 MTI electronic services may not be normally functional and/or delayed due to internet speed and network congestion, including in case of the user's or service provider's equipment malfunctions, disconnection, being turned off or not working. Under these circumstances, the Company shall not be liable for any delays, failures, damages or losses resulting from such problems.

11. Intellectual Property Rights

The Company is the owner of the intellectual property rights of materials contained in MTI electronic system, for example, graphic designs, data collected, product information, programs, password and/or related software. ("content"). The user must not sell, allow to use, distribute, reproduce, improve, publicize, create, adjust, modify, or use the contents without permission. The Company shall reserve all rights, including what may be undisclosed in these terms and conditions of services.

12. Privacy Policy

12.1 The Company regards the privacy of all users as its first priority.

12.2 The Company promises to protect the privacy and personal data of all users in accordance with the "Privacy Policy".

12.3 The Company shall implement security measures with great care to protect the personal data of all users.

13. Contact Channels

14. Amendments

The terms and conditions of use of MTI electronic services and the Privacy Policy may be amended from time to time. The amendment shall be announced on MTI electronic service system, which the user must read and agree to accept such amendment before accessing to

use MTI electronic services. The amendment may be notified through a message that appears, and once the user clicks the "Accept" button, it shall be deemed as an acceptance of the amendments or changes in the terms and conditions of MTI electronic services and the Privacy Policy, as the case may be.

15 . Separation

If any terms under these terms and conditions and the Privacy Policy (as the case may be) is not applicable, the remaining terms and conditions of MTI electronic services and privacy policy shall remain in full effect.

16. Applicable Laws

16.1 The terms and conditions of electronic services and this privacy policy shall be governed by and construed in accordance with the laws of Thailand.

16.2 The Thai courts have the sole jurisdiction to adjudicate litigation or judicial proceedings or disputes that may arise out of or in connection with these terms and conditions of electronic services and this privacy policy.
